1. Purpose
These Terms of Use (the "Terms") govern access to and use of the PimsLead platform (the "Platform") published by OPIIM SARL. The Platform provides a B2B SaaS service for AI-powered leadership training, including a web backoffice for administrators and a mobile application for end users.
The Platform is intended exclusively for the employees of organizations that have signed a license agreement with OPIIM SARL.
2. Accounts and Access
2.1 Administrators
Administrators (super admin, organization admin, department admin) access the backoffice via an email magic link or one-time password (OTP). Each administrator is responsible for the confidentiality of their authentication factors.
2.2 End users
End users access the mobile application anonymously using a unique access code provided by their organization. The code is personal: it may not be shared, sold or transferred. Each access code is intended for a single individual identified by the customer organization.
End users may add up to a reasonable number of devices to the same account through the device linking flow. A recovery key is generated at first login and must be kept securely; it is the only way to recover the account if all devices are lost.
3. Acceptable Use
Users undertake to:
- Use the Platform in accordance with applicable law, professional ethics and the policies of their organization.
- Not introduce malicious code, attempt unauthorized access, scrape, abuse the AI agents, or interfere with the security or integrity of the Platform.
- Not impersonate another user nor share their access credentials or access code.
- Treat the AI agents (Scenariste, Personnage, Coach) as training tools: their output is informative and does not replace the judgment of a qualified professional.
- Not submit to the AI any personal data of identifiable third parties, confidential business information beyond what the training requires, or any content that is illegal, defamatory, harassing or contrary to public order.
OPIIM SARL reserves the right to suspend any account in case of breach of these obligations, without prejudice to the customer organization's contractual rights.
4. Intellectual Property
All elements of the Platform are protected by intellectual property law. Users are granted a personal, non-transferable, non-exclusive right to use the Platform for the duration of their access. No license on the source code, the scenario library, the prompts or the brand is granted by these Terms.
Content created by users (free-form responses, feedback) may be used by OPIIM SARL in anonymized form to improve the service.
5. Availability and Maintenance
OPIIM SARL strives to ensure the availability of the Platform 24/7 but does not guarantee uninterrupted access. Maintenance operations may temporarily restrict access; significant scheduled maintenance will be announced through the backoffice.
6. Personal Data
The processing of personal data is described in the Privacy Policy (politique de confidentialité), which is an integral part of these Terms.
7. Liability
The Platform is provided "as is". OPIIM SARL's liability is limited to direct and foreseeable damages resulting from a proven breach of its contractual obligations and is capped, in any case, by the contractual terms agreed with the customer organization.
OPIIM SARL shall not be liable for indirect damages (loss of opportunity, loss of data, reputational harm) nor for damages resulting from the misuse of the Platform or from decisions taken based on AI-generated content.
8. Termination
Access to the Platform is automatically terminated at the end of the license agreement with the customer organization or in case of a serious breach of these Terms. Anonymous end-user data is then handled in accordance with the Privacy Policy.
9. Changes
OPIIM SARL may update these Terms. The updated version is published in the backoffice and on the marketing website with an updated date. Continued use after the publication of an update constitutes acceptance.
10. Governing Law and Jurisdiction
These Terms are governed by French law. Any dispute will be brought before the competent French courts.
